Received a speeding ticket doing 45mph in a 40 zone but a temp 30 in place! The vehicle is registered in my name but also has my mum and dad as named drivers! We all use the car and don't know who got caught! The ticket states where the offence took place which is the road we all use and there is no fixed camera, so must have been van/laser. Also no mention for a speed awarness course being offered. Is there a way of finding out who was caught or just take the fine and points myself?

I would write to them and just say that you cannot confirm who was driving and could they provide further evidence. You should not accept guilt if you are not sure

what if they are unable to provide evidence? And how many points would it be if you know?

They offer it if they think its relevant/havent done it before.

Its just more ££££ for the Government if truth be told

I know people who have asked and then been allowed to go on it without it originally being offered.

If they can't prove who it was I would say they are pretty useless, can't just charge the family.

Your only looking at 3 points, if your more than 20mph over the speed limit they can hit you with six I think.

In theory they have to prove it is you I think, the burden of proof is on them I imagine if you can prove other people are using the car, I don't know if I am honest and I am not sure how much hassle they might but you through if you say it wasn't you, I reckon you would get 3 points

I think it's the responsibility of the car's legal owner to provide the details of the person driving the car at that time. If they cannot do this then the owness rests with them... I think??
With regard to the speed awareness course you will only get offered once you have admitted guilt. As a guide if you got caught in the 30 zone doing 45 you probably wont get offered the course, if it was in the 40 zone you will.
The speed limit where you got caught will be on the original intention to prosecute.

Me and my mate were having a convo about this as it happened to us both within weeks of one another

Firstly, I was pissed because I thought they had to be in plain sight and this fella can in no way have been in plain sight so that was the first thing

When I got the letter, I wrote to them saying it was my car and therefore probably me but could they send me a picture which BTW happened to be the back of my car and therefore could have been anyone

My mate wrote back and said he didn't know who was driving the car that day, it could have been anyone as several people lived in the house who were fully insured and never heard a thing back about it!

My theory is that they are sitting off somewhere and clocking drivers without being in plain sight and therefore get the back of your carso I'd go for my mates option if it was me again and deny everything unless they can prove it was me (with a front facing photo) which of course it might not have be seeing as lots of people could drive my car Wink

Just read the back of the form and says "you are expected to do everything in your power to give information if you don't know who was driving, failing to do so ultimately the conviction is for the registered owner"

They rake in hundreds of thousands doing this. My missus got done doing 33 in a 30 in a notoriously bad area for it. They are literally charging people by the bucketload who are 1mph over.

She did the course cos it wasn't much more than the fine.
